Terms of Use & EULA

These Terms of Use (the "Terms") form a binding agreement between you and the operator of EVizee ("EVizee", "we", "us", or "our") and govern your access to and use of the EVizee mobile application, the website at evizee.co, and any related services (collectively, the "Service"). EVizee is currently operated as an unregistered project by its founder; once formally incorporated, these Terms will be updated to identify the operating entity. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

• You are responsible for keeping your credentials and devices secure
• You may not share your account or use someone else's account without permission
• Notify us at hello@evizee.co immediately of any unauthorized use
• We may suspend or terminate accounts that violate these Terms or that we suspect were obtained fraudulently

Subject to your compliance with these Terms, EVizee grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the EVizee mobile application on devices that you own or control, and to access the website, solely for your personal, non-commercial use.

You may not, and may not allow others to:

• Copy, modify, distribute, sell, lease, or sublicense any part of the Service
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, except where this restriction is prohibited by law
• Remove or alter any proprietary notices or labels
• Access the Service to build a competing product or copy its features
• Use automated means (bots, scrapers, crawlers) to access the Service or extract data, except for publicly documented APIs

The Service is licensed, not sold. EVizee retains all right, title, and interest in and to the Service, including all related intellectual property rights. All rights not expressly granted are reserved.

If you obtained the EVizee app through the Apple App Store, you acknowledge:

• This EULA is between you and EVizee only, not with Apple. Apple is not responsible for the app or its content.
• The license is limited to use on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support. Any product warranty is the sole responsibility of EVizee, to the extent applicable.
• Apple is not responsible for product or third-party claims relating to the app, including product liability, regulatory non-conformity, or consumer protection claims.
• If a third party claims the app or your possession and use of it infringes its intellectual property rights, EVizee, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated as a "terrorist supporting" country, and that you are not on any U.S. Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

The Service lets you submit charging stations, photos, reviews, posts, comments, and other content ("User Content"). You retain ownership of your User Content. By submitting it, you grant EVizee a worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works of (such as AI-generated summaries or thumbnails), publicly display, and distribute the User Content within and in connection with the Service.

You represent and warrant that:

• You own or have the necessary rights to submit the User Content
• The User Content is accurate to the best of your knowledge (this matters for station data)
• The User Content does not violate any third-party rights or applicable law

You agree not to:

• Submit false, misleading, or duplicate station data
• Post content that is illegal, hateful, harassing, defamatory, sexually explicit, or that incites violence
• Impersonate any person or misrepresent your affiliation
• Attempt to manipulate spark, votes, badges, or verification (e.g., sock-puppet accounts, coordinated voting)
• Interfere with the Service's security, integrity, or availability
• Probe, scan, or test for vulnerabilities without our written permission
• Use the Service to transmit malware or spam

We may remove any User Content and suspend or terminate any account at our discretion to enforce these rules.

• Stations become verified after three independent community confirmations; verification is not a guarantee of accuracy or that a station is currently operating
• Spark points and badges are virtual recognition only — they have no monetary value, are non-transferable, and cannot be exchanged for cash or any other consideration
• We may adjust, reset, or revoke spark and badges to correct errors or address abuse

The Service offers a Free tier and a paid Pro tier. Pro is billed through the Apple App Store or Google Play and is governed by the platform's subscription terms.

• Subscriptions auto-renew until cancelled
• Manage or cancel through your App Store or Google Play account settings
• Refunds, price changes, and trial terms are governed by the relevant store
• Free-tier features (such as 3 AI trip plans per month) reset on a monthly basis
• We may change features, pricing, or limits with reasonable notice

The Service integrates with third-party services such as Apple Sign In, Google Sign-In, Anthropic (Claude AI), Cloudflare, RevenueCat, the Apple App Store, and Google Play. Those services are governed by their own terms and privacy policies, which apply when you use them. EVizee is not responsible for third-party services.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not own or operate charging stations and we do not warrant that station data — including availability, pricing, connector types, or current status — is accurate or up to date.

AI-generated content (such as trip plans and review summaries) is provided for informational purposes and may contain errors. Always verify critical charging decisions independently. Do not rely solely on the Service for safety-critical decisions, including those involving range or roadside assistance.

To the maximum extent permitted by law, EVizee and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the twelve months before the claim, or (b) USD 50.

You agree to indemnify and hold harmless EVizee and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of (a) your User Content, (b) your use of the Service, or (c) your violation of these Terms or any law or third-party right.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, for any violation of these Terms or for any conduct that we believe is harmful to other users, to EVizee, or to third parties. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

EVizee is currently operated as an unregistered project by its founder. These Terms are governed by the laws of the founder's country of residence, without regard to conflict-of-laws principles. You agree to first attempt to resolve any dispute informally by emailing us at hello@evizee.co. If a dispute is not resolved within 30 days, it will be brought exclusively in the competent courts of that jurisdiction, unless mandatory consumer-protection laws of your country of residence provide otherwise. Once EVizee is formally incorporated, this section will be updated to reference the operating entity and its registered jurisdiction, and the "Effective date" above will reflect that change.

We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and provide notice in-app or by email when appropriate. Continued use of the Service after the change means you accept the updated Terms.
